The Decision

The hearing officer must:

  • Make a decision based on clear and convincing evidence
  • Explain the decision using facts and the regulations and policy that apply
  • Write a report that includes:
    • What was found
    • What was decided
    • Why the decision was made
    • Any recommendations

The decision must also:

  • Say why the person was found guilty or not
  • List the evidence and rules used
  • Respond to any strong arguments made by the person or their representative

Getting the Decision

The hearing officer will:

  • Send the decision in writing
  • Tell the person they can appeal the decision in circuit court

If the person is found guilty, the letter will say they will be disqualified from getting benefits.

If the person is found not guilty, the person may still have to pay back the extra benefits that they received.

Can the Decision Be Changed?

  • There is no other appeal through the agency after the hearing.
  • The decision cannot be changed by another agency hearing.
  • The person can still go to circuit court to try to change the decision.
